Terms of Use, Policies and Disclaimers

This document sets out the terms of use, policies and disclaimers (“Terms of Use”) that govern your access to and use of our website available at investvio.com, including all related sub‑domains, associated websites and services (collectively, “Investvio” or the “Platform”). By accessing or using the Platform in any way, you acknowledge that you have read, understood and agree to be bound by these Terms of Use. If you do not agree, you must not use the Platform.

The term “User” refers to any natural or legal person who accesses or uses the Platform, with or without registration. The terms “we”, “us” and “our” refer to the company that owns the Investvio brand and its affiliates.

Please note that, subject to mandatory applicable law, these Terms of Use constitute a binding agreement between you and Investvio and may include provisions regarding dispute resolution and limitation of liability. This text does not constitute legal advice; you should consult your own legal adviser where appropriate.

1. Changes to the Terms

1.1. Investvio reserves the right, at its sole discretion, to update, amend or replace these Terms of Use at any time. Any changes will become effective immediately upon posting the updated version on the Platform.

1.2. Your continued access to or use of the Platform after such changes have been posted constitutes your full and unconditional acceptance of the updated Terms of Use. It is your responsibility to review the Terms regularly.

2. Changes to the Platform and Services

2.1. Without prior notice, Investvio may change, suspend or discontinue the Platform or any feature, tool, content or service, in whole or in part.

2.2. In particular, due to technical requirements, legal or regulatory changes, relationships with data providers, security reasons or business decisions, we may modify the scope, operation, availability and functionality of our services. We do not guarantee backward compatibility of APIs, data feeds, charting tools, alerts, notifications or any other modules.

3. Intellectual Property and License

3.1. Unless expressly stated otherwise, all rights, title and interest in and to the Platform and all content, software, interfaces, designs, graphics, logos, databases, texts, images, videos, trademarks and all other elements displayed on or provided through the Platform are owned by Investvio, its affiliates or its licensors/data providers.

3.2. Any market data, prices, indicators, charts, alerts, data streams, webhooks and other information made available via the Platform are licensed to you solely for personal and/or internal business use, for display purposes only, under a limited, non‑exclusive, non‑transferable, non‑sublicensable and revocable license.

3.3. This license explicitly excludes and prohibits any non‑display uses, including but not limited to:

  • Any form of automated trading, auto‑order generation or algorithmic decision‑making,

  • Feeding data into systems or processes that are machine‑driven and not directly human‑readable,

  • Using Platform data as a direct data source for price referencing, order validation, smart order routing, operational control or risk management systems,

  • Building products or services that are based on Investvio data in a way that circumvents or undermines restrictions imposed by our data providers.

    3.4. Non‑display, commercial or institutional use of our data or APIs is only permitted where you have entered into a separate, written agreement with Investvio that explicitly allows such usage. Otherwise, such use is strictly prohibited.

    3.5. When using the Platform you may not:

  • Reproduce, distribute, sell, rent, lease, sublicense or otherwise transfer any content to third parties,

  • Attempt to reverse engineer, decompile, disassemble, modify or create derivative works from the Platform, its software or any content, except to the extent such restrictions are prohibited by applicable law.

4. Attribution and Use of Screenshots

4.1. Investvio allows you to use screenshots of Investvio charts in analyses, educational materials, blog posts, social media posts and similar publications, provided that all of the following conditions are met:

  • A clear and visible attribution to Investvio is included on or near the visual (for example: “Charts provided by Investvio”),

  • The Investvio logo, trademarks and designs are not altered in a misleading way and are presented in their original context,

  • Your use does not suggest or imply any sponsorship, endorsement or official partnership by or with Investvio.

    4.2. Where Investvio charts or tools are shown in videos or in contexts where the Investvio mark is not directly visible on the chart, you must clearly state that the charting platform is provided by Investvio (for example: “Charting platform by Investvio”).

    4.3. Investvio reserves the right to take any measures it deems necessary — including account suspension and legal action — against misleading, harmful or non‑compliant uses of its brand, charts, widgets or tools.

5. Third‑Party Sites, Services and Advertisers

5.1. The Platform may contain links to third‑party websites, applications, platforms or content. Such links are provided solely for your convenience and do not imply any endorsement, approval or responsibility for the content, products or services made available by such third parties.

5.2. Any transactions or interactions you have with third‑party sites or services are strictly between you and the relevant third party. Investvio is not liable for any direct or indirect loss or damage arising out of or in connection with such dealings.

5.3. The Platform may display third‑party advertisements or sponsored content. Any agreement you enter into with an advertiser is solely between you and that advertiser; Investvio shall not be responsible for any loss or claim you may have against an advertiser.

6. Disclaimer of Warranties

6.1. The Platform, services, content, data, materials and products provided to you via the Platform are made available on an “as is” and “as available” basis. To the maximum extent permitted by law, Investvio makes no representations or warranties, express or implied, including but not limited to warranties of accuracy, reliability, completeness, timeliness, merchantability, fitness for a particular purpose or non‑infringement.

6.2. Without limiting the foregoing, we do not warrant that:

  • The Platform will be uninterrupted, secure or error‑free,

  • Any defects or errors will be corrected,

  • The Platform or any related systems are free of viruses or other harmful components,

  • The information obtained through the Platform will meet your requirements or expectations.

    6.3. Any material downloaded or otherwise obtained through the use of the Platform is accessed at your own discretion and risk. You are solely responsible for any damage to your devices or loss of data that results from such material.

    6.4. Nothing in this Section shall limit rights you may have under mandatory consumer protection laws; however, to the extent permitted by law, our liability is excluded or limited as described in these Terms of Use.

7. Investment and Trading Disclaimer

7.1. No information, data, chart, indicator, script, strategy, idea or other content made available through the Platform constitutes or shall be construed as investment advice, portfolio management, execution services or personalized financial recommendations.

7.2. Trading and investing in securities, derivatives, cryptoassets or other financial instruments involves significant risk and can result in substantial or total loss of capital. Short‑term or high‑frequency trading strategies (such as day trading) are particularly risky.

7.3. You are solely responsible for evaluating the risks associated with any trading or investment decisions. You should always consider your financial situation and risk tolerance and, where appropriate, consult an independent, qualified financial adviser before making any investment decision.

7.4. Investvio shall not be liable for any losses or damages — whether direct, indirect or consequential — arising from any trading or investment activity you or any third party engage in based on information, data or materials obtained through the Platform.

8. Hypothetical / Simulated Performance Results

8.1. Certain strategies, scripts, indicators or backtests available on the Platform may show hypothetical or simulated performance results. Such results are generated using historical data and do not reflect actual trading in real‑time market conditions.

8.2. Hypothetical performance has inherent limitations, including but not limited to:

  • It may not account for slippage, liquidity constraints, fees, commissions, taxes or latency,

  • It does not capture psychological factors, discipline or risk tolerance,

  • Past or simulated performance is not a guarantee or indication of future results.

    8.3. You acknowledge that reliance on hypothetical results is entirely at your own risk and that Investvio accepts no responsibility for any losses resulting from their use.

9. Registered Accounts

9.1. Certain features of the Platform (such as saving charts, creating alerts, publishing ideas or commenting) are only available to registered Users and require you to create an account with a username and password.

9.2. By registering an account, you represent and warrant that:

  • You have the legal capacity to enter into a binding agreement,

  • You will use the Platform in compliance with applicable laws and these Terms of Use,

  • All information you provide during registration and thereafter is true, accurate, current and complete, and you will keep it up‑to‑date.

    9.3. You may not open an account on behalf of another person without proper authority, nor may you sell, transfer, assign or share your account, username or other account rights (except where you are duly authorized to act on behalf of your employer or client).

10. Access and Security

10.1. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.

10.2. You must notify us promptly of any unauthorized use of your account or any other breach of security that you become aware of. Investvio shall not be liable for any loss or damage arising from your failure to comply with these security obligations, to the extent permitted by law.

10.3. We may, for security, operational, legal or business reasons, temporarily or permanently restrict, suspend or terminate your access to the Platform or any part of it.

11. Paid Plans, Payment and Cancellation

11.1. Investvio may offer free and/or paid subscription plans. Paid plans are billed in advance according to the billing cycle you select (for example, monthly or annually).

11.2. By subscribing to a paid plan you:

  • Authorize us to charge your selected payment method on a recurring basis, and

  • Acknowledge that your subscription will automatically renew at the end of each billing period unless you cancel it in accordance with these Terms.

    11.3. To cancel your subscription, you must follow the instructions in the billing or account settings section on the Platform. Requests sent by email or support ticket may not be sufficient to stop automatic renewal.

    11.4. Except where mandatory law requires otherwise or where we explicitly state so in a specific offer, refunds are at Investvio’s discretion and may be subject to additional terms published on the Platform.

12. App Store / Google Play Subscriptions

12.1. If you purchase or manage a subscription through a mobile app store (such as Apple App Store or Google Play Store), all such transactions are governed by that store’s own terms of service, refund policies and privacy rules.

12.2. Trial periods, automatic renewals and cancellation options for store‑based subscriptions must be managed through the relevant store interface. Investvio is not responsible for the acts or omissions of third‑party payment processors.

13. Feedback and Suggestions

13.1. Any ideas, suggestions, feedback, documents or proposals that you submit to us regarding the Platform (“Feedback”) are deemed to be non‑confidential.

13.2. By submitting Feedback, you grant Investvio a worldwide, perpetual, irrevocable, royalty‑free, transferable and sublicensable license to use, reproduce, modify, adapt, publish, translate, distribute and otherwise exploit such Feedback in any manner and for any purpose, without any obligation to compensate you.

14. User Content and Indemnification

14.1. You are solely responsible for all content that you upload, post, publish or otherwise make available via the Platform, including but not limited to text, data, images, comments, ideas, scripts and links.

14.2. You agree that your content will not:

  • Infringe any intellectual property, privacy, publicity or other rights of any third party,

  • Violate any applicable law, regulation or public policy,

  • Contain unlawful, threatening, abusive, defamatory, obscene, hateful, discriminatory or otherwise objectionable material,

  • Contain any viruses, malware or other harmful code.

    14.3. You agree to indemnify and hold harmless Investvio, its affiliates, officers, employees, agents and licensors from and against any and all claims, liabilities, damages, losses, costs and expenses (including reasonable attorneys’ fees) arising out of or in connection with:

  • Your use of the Platform,

  • Your violation of these Terms of Use or of any law or regulation,

  • Your infringement of any rights of any third party,

  • Any content you submit, post or make available through the Platform.

15. Suspension and Termination

15.1. Investvio may, at its sole discretion and without prior notice, suspend, restrict or terminate your account and/or access to the Platform, in whole or in part, if:

  • You violate these Terms of Use or any other applicable policy,

  • We are required to do so by law, regulation or court order,

  • We detect suspicious activity, fraud or security issues,

  • Technical, operational or commercial reasons make such action necessary.

    15.2. Upon termination of your account:

  • Your right to access and use the Platform will immediately cease,

  • Any licenses and rights granted to you under these Terms will, to the extent permitted by law, automatically terminate.

    15.3. We may, in accordance with applicable data protection laws and for legitimate business purposes (such as audits, security and legal compliance), retain certain records and information relating to your use of the Platform for a period of time.

16. Emails and Electronic Communications

16.1. By creating an account, you consent to receive electronic communications from us, including:

  • Service‑related announcements and updates,

  • Security alerts,

  • Notifications of changes to these Terms or other policies,

  • Marketing communications and special offers, where permitted by law and your preferences.

    16.2. You may adjust your marketing communication preferences at any time via the relevant settings or unsubscribe links in our messages. However, you may not opt out of receiving essential service or security notifications that are necessary for the operation of your account.

17. Third‑Party Software and Components

17.1. The Platform and related services may include third‑party software, libraries, tools or services, which are subject to the terms and conditions of the respective third‑party providers.

17.2. Investvio disclaims all warranties and assumes no responsibility with respect to such third‑party software or services. Your use of third‑party components is solely at your own risk and governed by the terms agreed between you and the relevant third party.

18. Limitation of Liability

18.1. To the maximum extent permitted by applicable law, Investvio and its group companies, directors, officers, employees, agents and licensors shall not be liable for any:

  • Loss of profits, revenue, data or goodwill,
  • Business interruption or loss of opportunities,
  • Indirect, incidental, consequential, punitive or special damages

arising out of or in connection with your access to or use of (or inability to access or use) the Platform, even if we have been advised of the possibility of such damages.

18.2. In any event, and to the extent permitted by law, Investvio’s aggregate liability to you under these Terms of Use shall be limited to the total subscription fees actually paid by you to Investvio for the Platform during the twelve (12) months immediately preceding the event giving rise to the claim, unless a different limit is explicitly agreed in a separate written contract.

19. Governing Law and Dispute Resolution

19.1. Subject to mandatory provisions of applicable law, these Terms of Use and any dispute arising out of or in connection with your use of the Platform shall be governed by the laws of the country in which the relevant Investvio legal entity is established, without regard to conflict‑of‑law rules.

19.2. The parties shall first attempt to resolve any dispute amicably and in good faith. If an amicable resolution cannot be reached within a reasonable time, the dispute may be submitted to arbitration or the competent courts, as may be specified in a separate policy or agreement or required by applicable law.

19.3. If any provision of these Terms of Use is held to be invalid or unenforceable, such provision shall be modified or interpreted to best accomplish the objectives of the original provision to the fullest extent permitted by law, and the remaining provisions shall remain in full force and effect.

By accessing or using the Platform, you acknowledge that you have read, understood and agreed to be bound by these Terms of Use, Policies and Disclaimers.
